The Code
effectively “trumps” all other Provincial laws. It is critical for
business entities to be aware of the implications of the Code in their
dealings with members of the public and, in particular, with their
employees. The adjudication process for Code proceedings will be
greatly altered in June of 2008 and the process will demand greater
resources (time and money) from business entities. Greater access to
Code proceedings and increased penalties for Code infractions make Code
proceedings an attractive venue for claimants seeking cash settlements.
A lack of proper training of Human Rights adjudicators will mean a much
higher risk of exposure for those who are subject to claims under the
Code.
