Cohen Highley’s Condominium Law expertise extends to all aspects of Condominium development and management, as well as litigation matters. We act for developers, Condominium Corporations, Condominium Boards, Property Managers and individual unit owners. We were active participants in the legislative review process which led to the enactment of the Condominium Act, 1998 and we have contributed heavily to numerous seminars and educational events relating to the Act and related issues. Effective Consultation and Dispute Resolution

Draft all relevant Condominium documents including Declaration, By-laws, Rules, and exclusive use agreements;

Avoid court proceedings through effective negotiations with unit owners, municipalities or board members;

Formulate and implement By-laws and Rules to proactively address issues which typically form the basis for disputes;

Create leverage and assist in negotiations with third party suppliers such as contractors, property managers or governmental agencies;

Plan and implement Condominium Conversion strategies both with municipalities and with tenants;

Establish and implement procedures for enforcement of By-Laws and rules in Condominium Corporations;

Plan and implement strategies to convert residential rental properties to Condominium status, while ensuring that such a conversion will ultimately make economic sense;

Ensure that resolutions are properly drafted and implemented and review third party contracts;

Provide legal advice to Condominium Board members and to Corporations;

Develop and implement strategies to protect Board members from allegations of breach of statutory obligations under the Act;

Negotiate with municipalities for development approval or approval of conversions to Condominium status;

Represent clients in proceedings to enforce by-laws and adherence to the requirements of the Condominium Act;

Arrange for registration of liens, title, descriptions and other real estate documentation.
